SMS Privacy Policy

Technique Ltd. (“we,” “us,” or “our”) is committed to protecting your privacy. This SMS Privacy Policy (“Policy”) governs how we collect, use, and manage personal information in connection with our SMS marketing program (“Program”) in compliance with Canada’s Anti-Spam Legislation (CASL), the Personal Information Protection and Electronic Documents Act (PIPEDA), and, where applicable, Ontario’s Personal Health Information Protection Act, 2004 (PHIPA). By participating in our Program, you agree to the terms of this Policy.

1. Information We Collect

We collect personal information you voluntarily provide when you opt in to our Program, including:

  • Mobile Phone Number: Provided when you sign up for SMS communications.
  • Consent Information: Records of your express consent to receive SMS messages, including the date, time, and method of opt-in.
  • Other Information: Any additional details you provide, such as your name or preferences, when interacting with our Program (e.g., during sign-up forms or inquiries).

We may collect this information through:

  • Online forms (e.g., website pop-ups or checkout pages at techniqueit.com) where you check a box to opt in to SMS messages.
  • Text message opt-ins (e.g., texting a keyword like “JOIN” to our designated number).
  • Point-of-sale sign-ups or other direct interactions where you provide written or oral consent.

Note: Technique Ltd. does not collect personal health information through this Program. If personal health information is inadvertently collected, it will be handled in accordance with PHIPA and securely deleted unless explicit consent for its use is obtained.

2. How We Use Your Information

We use your personal information to:

  • Send you commercial electronic messages (CEMs), such as promotional offers, discounts, product updates, or event reminders, via SMS.
  • Respond to your inquiries or requests sent through the Program.
  • Track abandoned cart activity (if applicable) to send reminders about items left in your online cart, using website cookies or plugins as disclosed at the point of collection.
  • Maintain records of your consent to ensure compliance with CASL.
  • Improve our SMS services and personalize your experience.

3. Consent

Under CASL, we require your express consent to send SMS messages. You provide express consent by:

  • Checking an opt-in box on our website (techniqueit.com) or forms, explicitly agreeing to receive SMS messages.
  • Texting a designated keyword (e.g., “JOIN”) to our short code or toll-free number.
  • Signing a physical or digital document agreeing to receive SMS messages.

We do not rely on implied consent for SMS communications. Consent for SMS messages is specific to this channel and does not extend to other communication methods (e.g., email or social media). You may withdraw your consent at any time (see Section 6).

We maintain records of your consent, including how and when it was obtained, to demonstrate compliance with CASL and, where applicable, PHIPA.

4. Sharing Your Information

We do not sell, rent, lease, or trade your personal information for profit. We may share your information with:

  • Service Providers: Third-party vendors (e.g., SMS platform providers or phone carriers) who assist us in delivering SMS messages. These providers are contractually obligated to protect your information and comply with Canadian and Ontario privacy laws.
  • Legal Obligations: We may disclose information to comply with legal requirements, such as responding to government requests or protecting our rights, in accordance with PIPEDA, CASL, and PHIPA.

We ensure that any third party receiving your information adheres to PIPEDA, PHIPA (if applicable), and other relevant privacy regulations.

5. Security of Your Information

We take reasonable measures to protect your personal information, including:

  • Using secure SMS platforms and encryption where applicable.
  • Limiting access to your information to authorized personnel only.
  • Implementing policies to prevent unauthorized access or disclosure, in line with PIPEDA and PHIPA standards.

However, no method of transmission is 100% secure. While we strive to protect your data, we cannot guarantee absolute security, as your information may travel through third-party infrastructures (e.g., carrier networks) beyond our control.

6. Opting Out

You can opt out of receiving SMS messages at any time by:

  • Replying “STOP” to any SMS message you receive from us.
  • Clicking a provided link in an SMS message that directs you to an unsubscribe webpage.
  • Contacting us directly at services+privacy@technique.ca or (888) 265-7064.

Upon receiving your opt-out request, we will send a confirmation message and cease sending SMS messages within 10 business days, as required by CASL. You may still receive transactional messages (e.g., order confirmations) if applicable.

7. Your Rights

Under PIPEDA and, where applicable, PHIPA, you have the right to:

  • Access: Request access to the personal information we hold about you.
  • Correct: Request corrections to inaccurate or incomplete information.
  • Withdraw Consent: Stop receiving SMS messages at any time.

8. Third-Party Links

Our SMS messages may include links to our website (techniqueit.com) or other online resources. This Policy does not apply to third-party websites, even if linked from our SMS messages. We encourage you to review the privacy policies of any linked sites.

9. Updates to This Policy

We may update this Policy to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated Policy on our website (techniqueit.com) or sending an SMS message with a link to the updated Policy. The updated Policy is effective upon posting, and your continued use of the Program constitutes acceptance of the changes.

11. Compliance with CASL, PIPEDA, and PHIPA

This Policy is designed to comply with CASL, PIPEDA, and, where applicable, PHIPA. All SMS messages include:

  • Identification of Technique Ltd. as the sender.
  • Contact information or a link to a webpage with our contact details.
  • A clear and simple unsubscribe mechanism (e.g., “Reply STOP to cancel”).

We send SMS messages only between 9 a.m. and 8 p.m. in your local time to respect quiet hours, as recommended by CASL guidelines.
